Charges against DePauw dismissed by federal judge; sent back to circuit court

"It remains DePauw University's position that those claims do not have any merit."

INDIANAPOLIS -- Charges -- three of five -- brought by one of its adjunct instructors that UM-related DePauw University violated her U.S. Constitutional rights to freedom of speech and religion were dismissed last month by Federal Judge Richard Young.

In his ruling, Young said that two remaining claims filed by Price's lawsuit could be heard in a state court, which would have to decide whether tax-funded financial aid and scholarships offered through the university mean that it must follow state constitutional guarantees.

In the lawsuit, Price claims that distribution of an evangelical organization's magazine, "Teachers in Focus," in her education class caused her to lose the teaching assignment, after a student complained to the dean about the publication's "anti-homosexual" bias. University officials argued that a drop in class enrollment in her subject area was the reason Price wasn't asked to teach the course again. Price continues to hold a staff position in DePauw's Education Department office.

Her attorney, John Price (no relation), was quoted in the Indianapolis Star last month as saying " … the decision means that Janis Price will eventually have her day in court." 

University Spokesman Ken Owen told the Hoosier UM News that DePauw officials were pleased with Judge Young's decision, and that his remanding of Price's remaining claims to state court was not unexpected.

A statement released by Owen's office says the University will renew its motion to dismiss those two claims with the state court.
